General terms and conditions

1 General provisions – scope

1. 1. The following general terms and conditions, as amended from time to time, apply to all business relationships between NewView and the course participant. The version valid at the time the contract is concluded is the one that applies.
1.2. Differing, conflicting or supplementary general terms and conditions do not become part of the contract, even if known, unless their applicability is expressly agreed to.
1.3. Consumers are consumers within the meaning of the Austrian Consumer Protection Act (Konsumentenschutzgesetz, KSchG) and thus natural or legal persons who are not entrepreneurs. Entrepreneurs are natural or legal persons or legally capable persons or legally capable partnerships for whom the contract in question forms part of the operation of their business. Enterprises are all permanently established organisations of independent economic activity, even if not directed at profit. Customers are both consumers and entrepreneurs.

2 Registration

2.1. Registration for a course or seminar must be made in writing. Registration may be made by post or by email (eva-maria.kraus@newview.at).
2.2. By registering, the course participant declares their participation as binding. For registrations made electronically, we will confirm receipt of the registration to the course participant without delay. Confirmation of receipt does not constitute a binding acceptance of the registration. Confirmation of receipt constitutes a declaration of acceptance only if we expressly state this.
2.3. NewView is entitled to accept a registration for a course or seminar within one week. In the case of registration by electronic means, NewView is entitled to accept the registration within three working days of receipt.
2.4. If the number of participants in a course or seminar is limited, the order of legally effective registrations determines participation.

3 Payment terms

3.1. All prices stated on the website www.newview.at are in euros. The participation fee may be paid in cash or by payment slip (bank transfer). The participation fee must be paid no later than before the course begins. Compliance with the agreed payment arrangements and the payment date or dates is an essential condition for participation in the courses/seminars.
3.1.1. The course participant consents to an electronic invoice and to it being sent by email.
3.2 In the event of late payment, default interest of six per cent will be claimed.
3.3. The course participant undertakes to bear all costs and expenses connected with the collection of the fee, in particular debt collection charges or other costs necessary for appropriate legal enforcement.
3.4. Learning materials for courses/seminars are sent to the course participant only once a legally effective registration has been made and the participation fee has been paid in full.

4 Right of withdrawal (cancellation)

4.1. The course participant has the right to withdraw up to 14 days before the start of the course/seminar without incurring a cancellation fee. If withdrawal takes place within 14 days before the start of the course, 50% of the participation amount is charged as a cancellation fee, and 100% after the course/seminar has begun. A Saturday does not count as a working day. This right of withdrawal after conclusion of the contract does not apply if the participant granted a direct debit authorisation with the registration and therefore already received the learning materials (scripts etc.) upon conclusion of the contract (confirmation of registration) (§ 5f no. 1 KSchG). The withdrawal need not contain any reason and must be declared in writing (by post or by email). Sending it in good time is sufficient to meet the deadline.
4.2. NewView does not exclude the exclusion of a participant from a course/seminar on account of serious disciplinary offences or gross misconduct. In such a case the course participant has no claim to reimbursement of any part of their participation fee. The withdrawal period is met if the declaration of withdrawal is sent within the periodFor multi-day seminars, booking or cancelling individual seminar days is not possible.

5 Retention of title

5.1. NewView retains title to the goods supplied (course/seminar materials etc.) until all claims against the course participant, in particular the participation fee, have been paid in full.

6 Copyright protection

6.1. The course participant acknowledges that the course/seminar materials made available by NewView are protected by copyright. Reproduction, distribution or other use beyond private use is expressly prohibited to the course participant, and NewView reserves all rights in this respect.

7 Data protection

7.1. With our „data protection information“ we inform our course participants about:
– the nature, scope, duration and purpose of the collection, processing and use of the personal data required to carry out registrations;
– the transfer of data to companies commissioned by us and obliged to observe the statutory data protection provisions, for the purpose and for the duration of the credit check and the dispatch of materials;
– the right to free information about their personal data held by us;
– the right to rectification, erasure and blocking of their personal data stored by us.
7.3. Any collection, processing and use of personal data going beyond point 7.1. requires the consent of the course participant. The course participant has the opportunity to give this consent before declaring their registration. The course participant has the right to withdraw consent at any time with effect for the future.

8 Changes to courses/seminars

8.1. NewView reserves the right to cancel advertised courses/seminars definitively for compelling reasons. In such a case the course participant will be issued a credit note for any participation fee already paid. On written application by the course participant, the participation fee already paid will be refunded.
8.2. Any further claim for damages is excluded unless the damage was caused intentionally or through gross negligence by NewView or by a person attributable to NewView. Provided that the overall planning of the course/seminar is not substantially impaired, NewView reserves the right to change the instructors and to postpone dates within a reasonable framework. This does not give the course participant any right to extraordinary termination of the course/seminar or to a reduction of the participation fees.
8.3. NewView is entitled to limit the number of participants in courses and seminars. Holding group courses depends in particular on reaching the defined minimum number of participants.

9 Final provisions

9.1. Changes to NewView's general terms and conditions, together with the date on which they come into force, are announced by publication in a suitable form on the internet and at www.newview.at. For changes that are not exclusively to the benefit of the course participant, an announcement period of two months applies. At the latest one month before they come into force, the course participant is notified of the essential content and the date of entry into force. If the course participant does not object before these changes come into force, or cannot subsequently show credibly why a timely objection was not possible, the changes take effect for them.
9.2. Supplementary or amending agreements require the consent of both contracting parties and the written form to be effective.
9.3. Austrian law applies. Unless the KSchG excludes a choice of jurisdiction, the local jurisdiction of the court with subject-matter competence for NewView's registered office is agreed.
9.4. Should individual provisions of the contract with the course participant, including these general terms and conditions, be or become wholly or partly ineffective, the validity of the remaining provisions is not affected. The wholly or partly ineffective provision is replaced by a provision that corresponds in meaning to the ineffective provision, to the extent permitted within the statutory provisions.

To exercise your right of withdrawal, you must inform us, NewView, Furtwänglerplatz 44A, 1130 Vienna, Austria, email: eva-maria.kraus@newview.at, tel: +43 (699) 10305678, of your decision to withdraw from this contract by means of an unambiguous statement (for example a letter sent by post, or an email).

To meet the withdrawal deadline, it is sufficient that you send your notification of exercising the right of withdrawal before the withdrawal period expires.
The period begins on receipt of this notice in text form. Sending the withdrawal or the goods in good time is sufficient to meet the withdrawal deadline. The withdrawal is to be addressed to:
